De rechtbank vindt dat er niet gesproken kan worden van ontucht of ontuchtige handelingen, mede omdat de jongen en het meisje erg close met elkaar waren; ze hadden een liefdesrelatie. Het meisje had aangifte gedaan. Ze heeft bij de politie verklaard dat de Drachtster in de tweede helft van 2005 - zij was toen veertien, haar vriend was een jaar jonger - tegen haar wil seks met haar heeft gehad. De vriend bestreed dat.&lt;br&gt;<br /> &lt;br&gt;<br /> De twee hadden hebben een vrij intense liefdesrelatie gehad, met alles erop en eraan. Volgens de verdachte heeft hij het meisje wel degelijk gevraagd of zij met hem naar bed wilde. Het meisje liet volgens hem zelf blijken dat ze dit wilde en dat ze eraan toe was. De rechtbank ziet geen reden om aan de verklaring van de jongen te twijfelen. Ook speelt mee dat het stel twee keer seks heeft gehad. De tweede keer was nadat de jongen het meisje misbruikt zou hebben. In eerste instantie heeft het meisje niets verklaard over die tweede keer. Bovendien bleef zij daarna contact zoeken met de verdachte.
