Men kan van juristen niet eisen dat zij diepgaande meningsverschillen overbruggen met formuleringen die aan alle standpunten recht doen; hoewel de nota &quot;Zeden en Straffen&quot; daartoe een aantrekkelijker poging levert dan de aanbevelingen van de Kommissie-Melai. De huidige zedelijkheidswetgeving is geformuleerd in 1881, toen de openbare orde centraal stond, en in 1911, toen de christelijke moraal tot politiek werd verklaard door minister Regout. De demokratiserings- en emancipatiegolf, leidde tot een strijd die stukliep op de persoon van minister Van Agt als verdediger van de christelijke moraal.&lt;br&gt;<br /> &lt;br&gt;<br /> Toen daarna onder minister De Ruiter een proces van ont-moralisering van de strafwet alsnog op gang leek te komen, ontstond daartegen verzet van een deel van de vrouwenbeweging naar aanleiding van de schadelijkheid van pornografie. Mede door deze invloed greep de Kommissie-Melai in 1981 terug naar het model van 1881 in plaats van de konseptie van haar oorspronkelijke uitgangspunt te hanteren: de rechten van de mens in een open, pluriforme samenleving. Het grondwettelijk vastgelegde zelfbeschikkingsrecht van elk individu dient door de overheid gewaarborgd te worden; zeker waar het gaat om de integriteit van het menselijk lichaam en de privésfeer. Wie echter, als sommige vrouwengroepen, hierbij het persoonlijke tot politiek maakt, dringt eigen inzichten op als norm en is dan langs een omweg terug bij de wetgever van 1911. Bescherming mag niet ontaarden in betutteling, maar moet ieders keuzevrijheid waarborgen - met name die van zwakken en kwetsbaren. Het is bovendien de vraag, of kwetsbaarheid en afhankelijkheid en affectieve relaties rechtstreeks voortvloeit uit achterstelling op sociaal-ekonomisch terrein.
