Justices: Kids' sex was not a crime
The Ohio Supreme Court yesterday overturned the rape conviction of a 12-year-old Licking County boy who had sex with an 11-year-old friend. There was no crime, the justices decided, because both children were younger than 13 and the sex was consensual. [...] The ruling reversed a decision by the 5th District Court of Appeals, which upheld the boy's conviction. [...] The older boy was found guilty of multiple delinquency counts of statutory rape and committed to the Ohio Department of Youth Services until his 21st birthday. The sentence, however, was suspended and the boy has been in counseling and sex-offender therapy for nearly three years.
